Nevada Workers Compensation Insurance is no longer provided through a state fund.  Now employers can purchase Workers Compensation  from a private insurance company that is authorized to sell Nevada Workers Compensation Insurance.  Workers Compensation Insurance was create to protect you business when an employee in injured while working on the job.  If the employee is injured or contracts an illness, your business or the insurance company is liable to pay out benefit compensation.  Nevada Workers Compensation law can be tricky and change pretty frequently, so it is good to have a trusted partner working with you to make sure you are in compliance.

Does my Company Require Nevada Workers Compensation Insurance?

Nevada law requires all business owners to obtain and maintain Nevada Workers Compensation Insurance coverage, especially those companies with 1 or more employees.  The state defines an employee as every person that is in the service of an employer whether legally or illegally. 

Who is Exempt From Nevada Workers Compensation Insurance Coverage?

An employee is exempt from Nevada Workers Compensation if they fall under any one of these categories:

  1. Any person whose is both casual and not in the course of the trade, business, profession or occupation of his employer
  2. Any person that is a theatrical or stage performer or in an exhibition
  3. Musicians when their services are merely casual in nature and not lasing more than 2 consecutive days, and not recurring for the same company
  4. Anyone one involved in household domestic service, farm, dairy, agricultural, in stock or poultry raising.
  5. Any clergyman, rabbi, or lay reader in the service of the church
  6. Any real estate broker or salesman

Nevada Workers Compensation Benefits

Full medical benefits are provided to an employee under Nevada Workers Compensation Insurance.  The medical benefits include all visits to the doctor, hospital coverage, medical devices, prescriptions, and travel reimbursement.

Nevada Workers Compensation Insurance provides employees with wages based off a percentage of the workers weekly wage.  Payments are subject to a weekly maximum amount depending on the average wage and the type of claim.  Employees are able to receive up to 2/3 of their average weekly wages as compensation.

Employees are also able to receive additional training paid for by Nevada Workers Compensation Insurance.  This training can be obtained if the employee is unable to compete for a job on the open market or if the employer does not have an adequate position open.

What if my Company Does Not Have Adequate Workers Compensation Insurance?

If you do not obtain Nevada Workers Compensation Insurance coverage you company is liable for a fine up to $15,000, as well as missed premium penalties.  If an investigator finds you business is not in compliance they can force a stop order until the proper coverage is obtained.  There can also be criminal charges brought against your company if any of the claims lead to substantial injury or death.
